J&K unveils scheme for levying of charges for change in land use permitted under Master Plan

Srinagar: The administration of Jammu and Kashmir has unveiled a scheme for levying charges for change in land use as permitted in the Master Plan and or the zonal plan.

The scheme, a copy of which is lying with The Precious Kashmir, has been notified under section 11-A of ā€œThe Jammu and Kashmir Development Act-1970ā€.

The scheme notified by the Housing & Urban Development Department will be applicable where a Master Plan or a zonal plan notified in terms of the Jammu & Kashmir Land Development Act-1970, has come into force, and the permission for change in land use shall be strictly in accordance with the permitted land use under such master plan or zonal plan.

ā€œThe development authority having jurisdiction over the area in respect of which the permission for change in land use is sought shall be the competent authority to grant permission for change in land,ā€ reads the scheme guidelines.

The scheme defines how the fee for change in land use shall be calculated.

According to the scheme, no fee shall be charged for change in land use for plots measuring upto one Kanal for residential purposes.

The scheme also prohibits charging of fee for change in land use if the applicant establishes that the fee for change in land use has been paid under the provisions of The Jammu and Kashmir Land Revenue Act.

According to the notification, any amount received by the concerned authority on account of these charges shall be kept in a separate account to be used by the authority for acquisition of any land that may be required to be acquired in terms of section 50 of The Jammu and Kashmir Development Act-1970.
