Chief Justice seeks progress on pending cases against former MLAs, MPs: Fixes next date of hearing on October 21

Srinagar: Chief Justice of Jammu and Kashmir and Ladakh Pankaj Mithal has sought the progress of all pending cases registered against the former Members of Parliament and Members of Legislative Assembly.

“In view of directions contained in the order dated 16/09/2020 of the Supreme Court passed in writ petition (Civil) No.699/2016 directing for monitoring the progress of the trial of cases pending against the sitting/ former legislators (MPs or MLAs), on the directions of Chief Justice, the Registry has registered this PIL as “Court on its own motion versus Union of India and others,” reads the order issued in this regard a copy of which lies with Precious Kashmir.

“In this suo-moto motion, the “Union of India” shall be represented through Home Secretary, “Union Territory of J&K” through Commissioner Secretary, Home and “Union Territory of Ladakh” through Commissioner Secretary, Home,” it added.

“Let the respondents be arrayed accordingly and notice of this motion may be given to Mr. T.M. Shamsi, learned ASGI who represents not only Union of India but Union Territory of Ladakh as well and Mr. D.C. Raina, learned Advocate General to Union Territory of Jammu and Kashmir,” it added.

“Both the learned counsel would inform the court on next date as to the number of trials which are pending in different subordinate courts as well as the matters pending in the High Court against the said MPs or MLA,” It added further.

As per order, the next date of hearing is on 21 October this year.
