HC rejects bail application of NC leader’s son

Srinagar, Apr 24: The Jammu & Kashmir High Court on Friday dismissed the bail application of senior National Conference leader, Abdul Rahim Rather’s son in multi-crore bank fraud case.

A single bench of the High Court headed by Justice Puneet Gupta dismissed the bail application moved by Hilal Rather, son of former Finance Minister Abdul Rahim Rather, on medical grounds.

“The application being without merit is dismissed. The merits of the case have not been argued by the counsels as the application for bail was mainly confined on medical grounds,” reads the High Court order.

The Court observed that bail cannot be granted on the mere asking of the accused nor can the accused claim bail as a matter of right. “Each case has to be decided on its own merits,” the court observed. It also observed that the  case of the accused is not covered by the directions of the Supreme Court for decongesting jails in the wake of outbreak of deadly coronavirus

“The other contention of the learned counsel for the accused is that the case of the accused is covered by the directions of the Hon’ble Supreme Court issued in view of the spread of COVID-19 and the lockdown which is in force.

“The learned counsel for the respondent has argued that the case of the accused is not covered by the directions of the Hon’ble Supreme Court and in any case the charges in which the accused has been booked carry the punishment for more than seven years,” reads the court order.

The court observed that the apprehension raised by counsel for the accused that the accused may contact infection or even can infect other inmates of the jail due to the prevailing conditions is not borne out from the record. “The court finds no material on record which substantiates the argument of the counsel for the accused.

“The apprehension of the accused is misplaced as of now. The Jail authorities must be otherwise taking all the measures to keep the jail in hygienic conditions keeping in view the onslaught of COVID-19. The bail cannot be granted on mere assumption that the conditions in the jail are unhygienic and that the accused will suffer for that reason,” the order states.

Citizen Mamata Banerjee Wants Lockdown Gone “2 Weeks After May 4”

Kolkata : A hundred per cent removal of lockdown two weeks after May 4 — that tops the the wishlist of Mamata Banerjee as a citizen and the chief of Trinamool Congress. Asked about her opinion on the lifting of the lockdown four days before the video-conference with Prime Minister Narendra Modi, the Bengal Chief Minister today said she would “share opinion only when asked (by the Prime Minister)”.

“As a citizen and TMC chief, I want lockdown to be scaled back,” Ms Banerjee told NDTV. The lifting of the lockdown, she added, should be done in three stages.

“Lift 25 per cent of lockdown in week beginning May 4, reopen 50 per cent in second week after May 4, and 100 per cent roll back should happen in two weeks after May 4,” she said.

No room for complacency

The number of COVID-19 cases in Jammu and Kashmir surpassed 400-mark and till date Kashmir has 370 and Jammu 57 Covid-19 patients. The higher number of cases in Kashmir is perhaps due to the fact that people from Valley travel more than their counterparts in Jammu. Besides for livelihood, a significant number of people go to Saudi Arabia and Iran for religious purposes. Many well-off Kashmiris also visit countries like Dubai and the other Gulf and Arab countries to escape the winter. Come March, a large number of them return home. Depicted in data for the Covid-19 cases, around 30 percent of them have history of travel to outside while around 60% are contacts of the previous patients.
Even though the COVID-19 cases in the Kashmir are still within manageable levels, there is need to arrest the trend and no room for complacency. One would advocate continuing with the lockdown strictly for now but there are questions particularly what after the lockdown comes to an end. For how long can the devastating economic impact of the shutdown of the businesses would be allowed?
For now, there is partially relaxing of the lockdown for COVID-19 in zones that do not have high concern.
After having eased the restrictions after about a month, the Jammu and Kashmir government must have got the feedback on how to go about it. This is of course beyond the manner, form and related areas that stand incorporated in Standard Operating Procedures (SOPs). There is no doubt that all the activities—commercial, industrial and services—cannot start suddenly. The government has already specified selected industrial, construction and some other activities that would be allowed for the time being.
There are currently over 90 red zones in the J&K, of which considerable numbers are in the Valley. As per an SOP for red zones issued on April 14, the administration has 100 per cent survey and screening of all persons within the red zone.
So far as the Red Zones are concerned, no activities would be allowed. Prudence and discretion demand need to be guarded against COVID-19 threat. Whatever gains have been made on account of lockdown must not only be consolidated but no effort should be spared in ensuring that more gains were made with intent to have zero and no fresh case of the infection from any corner.

Angry Trump talks tough as COVID-19 death toll nears 48000 mark in US

Pompeo says China failed to report virus outbreak to World Health Organization quickly
Afaq Bhat
Srinagar, Apr 23: President of United States, Donald Trump, has said that his country has been attacked by the COVID-19 virus and the preparators will be held accountable.
“In fact it’s not the United States only which is suffering, the COVID-19 has attacked 200 countries and  people are dying everywhere. Soon after the outbreak of COVID-19 pandemic the World Health Organization raised an alarm asking America and other countries to prepare themselves to fight a long-drawn battle. However, many countries didn’t take the warnings seriously and allowed things to go out of hand,” an analyst told Precious Kashmir.
He said that in the initial stages no country except India paid heed to the suggestion of WHO to go for a lockdown. “Countries like United Kingdom, Italy, Spain and even United States waited to go in a lockdown mode. This worsened the situation,” he added.
It may be recalled that a few days ago, President Trump announced to stop funding to WHO and accused it of failing to inform the world about the lurking danger. From the first day, he has been calling COVID-19 as “Chinese virus” and now he has directly started blaming China for putting entire world into a quandary.
US Secretary of State Mike Pompeo recently said that China failed to report the coronavirus outbreak to the World Health Organization quickly – as required by international law – and the WHO in turn failed to call Beijing out on its dereliction.
He said that he wasn’t making a legal determination on the issue at this time, but added that the WHO’s regulatory functions had “clearly failed during this pandemic.”
Another analyst said, “World leaders, including President Trump, taking a tough posture at this point of time is not going to help anyone’s cause. The priority right now is to find a cure. If one goes by the warnings being issued by the WHO then it seems that virus is going to last long and people should learn to live with it.”
He said, “ All the countries hit by the COVID-19 are trying to manufacture a vaccine and find a cure. Some researchers in United Kingdom are claiming that they have found the vaccine and are on the job to manufacture millions of doses. The other theory which is being talked about is plasma theory. Doctors have rejected Hydroxychloroquine as a drug to fight COVID-19. President Trump had threatened India of retaliation if it didn’t supply Hydroxychloroquine to the US. Following Trump’s tough posture India had dispatched thousands of units of the drug to America.”
An observer said that “President Trump seems very much worried about the declining economy of the United States. With only a few months left for Presidential elections in America, Trump is a worried person. He knows that he can face rejection in the polls if the outbreak of COVID-19 is not controlled.”
According to the media reports there are eight lakh fifty two thousand positive cases of COVID-19 in the United States and more than 47000 have died due to the pandemic till date.
