Jammu, Sep 15: The Jammu and Kashmir Anti-Corruption Bureau (ACB) has registered an FIR against Nisar Ahmad Shad, the then Assistant Commissioner (Revenue), Jammu, and four private beneficiaries over alleged irregularities in granting permissions for alienation and transfer of land recorded as “Gair Mumkin Khad” in Chowadi and Deeli areas of Jammu.
According to the ACB, FIR No. 12/2026 has been registered at Police Station ACB Central, Jammu, following the outcome of Preliminary Enquiry No. PE-JSK-17/2019.
The preliminary enquiry allegedly found that Shad, while functioning as Assistant Commissioner (Revenue) between May 23 and July 11, 2018, abused his official position by granting nine permissions for alienation or transfer of Gair Mumkin Khad land.
The ACB has alleged that the permissions were issued in violation of applicable revenue laws, Government orders and directions of the High Court concerning land recorded under the Gair Mumkin Khad category.
A significant aspect of the case concerns the purported approval of the Deputy Commissioner, Jammu.
According to the ACB, the nine permissions were shown to have been granted with the approval of the Deputy Commissioner. However, verification with the office of the Deputy Commissioner, Jammu, allegedly found that no corresponding approval, note sheet or formal delegation order was available on the official record.
The discrepancy forms part of the basis for the registration of the criminal case against the then revenue officer and the four private beneficiaries.
The FIR has been registered under Section 5(1)(d) read with Section 5(2) of the J&K Prevention of Corruption Act, Svt. 2006, besides Sections 120-B, 467, 468 and 471 of the Ranbir Penal Code.
The charges relate to alleged abuse of official position, criminal conspiracy and offences concerning forgery and use of allegedly forged documents.
The ACB said further investigation into the matter is in progress. [KNT]
