Govt orders transfer of Revenue Court cases

Seeks details of matters transferred, retained within week’s time

Srinagar: In a significant move, the Jammu & Kashmir government has ordered that the revenue court cases pending with Additional Deputy Commissioner (headquarters) of the tehsils outside their territorial jurisdiction are transferred and assigned to the additional deputy commissioner within whose jurisdiction the tehsil lies.

The office of Financial Commissioner Revenue has directed the authorities that the revenue court cases which stand argued and are reserved for orders shall, however, not be transferred but continue in the court of ADC (headquarters) who shall pronounce the order on the date notified to the parties.

“The cases pending with additional deputy commissioner (headquarters) pertaining to the tehsils outside their territorial jurisdiction are hereby transferred and assigned to the additional deputy commissioner within whose territorial jurisdiction the tehsil lies,” reads the order, a copy of which is in possession of The Precious Kashmir.

The directive has been issued after it came into notice of the Government that a large number of cases are pending disposal at the level of ADC and ACR at the district headquarters.

On the similar lines, the government has also ordered transfer of the court cases relating to agrarian reforms pending with assistant commissioner (Revenue) in the capacity of collector agrarian reforms to respective sub-divisional magistrate in whose territorial jurisdiction the cases fall, for due disposal under law.

The government has directed the courts (ADC/ ACR) located at the headquarters to submit case-wise list of cases transferred and retained within a week’s time.

“Both the courts involved in the transfer process, the dispatching court as well as the receiving court, shall file compliance reports to this order along with the details of cases, upon the transfer being affected, on a weekly basis,” the order states.

The DCs have been directed to monitor the entire process.
