Govt notifies rules governing transfer of Agriculture land

‘Can be used only for purpose for which permission has been granted’

Srinagar: The agricultural land alienated by an agriculturist to a non-agriculturist in Jammu and Kashmir can be used only for the purpose for which permission has been granted by the Deputy Commissioner.

Days after the Administrative Council approved the alienation of an agricultural land by an agriculturist to a non-agriculturist; the Jammu and Kashmir’s Revenue department has come up with the rules and conditions governing the transfer of the land.

According to conditions governing the alienation of agricultural land by an agriculturist to a non-agriculturist, the land shall be used only for the purpose for which the permission has been granted.

“ The land acquired by transferee cannot be put to use/ transferred for any other purpose except for the purpose for which permission has been granted, subject to any further authorization and permission granted by the competent authority,” reads the conditions governing alienation of agricultural land to a non-agriculturist.

According to documents, the land shall be put to use for the purpose within a period of two years from the date of issuance of the permission order, provided that the district collector, may for reasons recorded in writing, extend the said period for one more year.

“Further extension of one year may be granted by divisional commissioner, for exceptional reasons, to be recorded in writing,” the documents state.

The government shall be kept informed of any extension in regular monthly reports and all such extensions will be subject to further orders/ restrictions by the government.

The guidelines state that transaction shall not make the transferor landless. “The applicant shall abide by all the Acts/ Rules/Regulations applicable on such lands,” read the guidelines.

It is worthwhile to mention that the administrative council had last month authorized the district collectors to grant permission to an agriculturist to alienate land to a non-agriculturist subject to certain conditions.
