Class fourth employees of Forest Deptt without promotion from last two decades

Srinagar, Jun 17: Having been deprived of promotion from last more than twenty years , the Class Fourth employees of the Forest Department have approached High Court challenging an order of the administrative department regarding their promotion and accusing it of depriving them their right. The administrative department in a communication to all HODs and PCCF Srinagar vide No. FST/NG/45/2018 dated 14-05-2019 directed that the seniority of Class forth be assigned from the date of their re- designation in the relevant categories or have separate seniority list of these re-designated ‘helpers’. The employees however, told RNA that the administrative department in the order has ignored all service rules which were injustice with the forest department Class fourth employees who have not been granted promotions from last nearly more than decade. They further said that not going according to SRO 64 of 1994 the department has chosen to deprive them of their right to promotion forcing them to challenge the order in the High court.
“The daily rated workers regularized with effect from 01-04-1994 and 01-04-1995 have been rightly given the seniority from the date of their regularization and most of them stand directly promoted to the next higher post. Our case is similarly poised as there is no change in class, category or grade and needs to be dealt on same analogy as had been adopted in the promotion process of class fourth employees regularized in 1994 and 1995 in terms of SRO 64 of 1994, as it is factual position of the case even a single line was not written on our 25 year regular service which we have rendered to the department.” reads the representation of these employees to government.
The high court in the meanwhile issued a notice to the department directing that it shall work out the entitlement of the petitioners for their promotion.
“If in the process it turns out that the petitioners are immediately entitled for further promotion, then the equal number of promotional posts in that category shall not be filled up till next date before the Bench.” Directed the Court .
In the meantime the Federation of the Forest Employees Association has rejected the complaint against the officials of the department who were accused by Class fourth union of thwarting the promotion process in lieu of financial kick backs. In après release to RNA, the federation said that there was no such issue and targeting the officials by union was unfortunate and condemnable. Thy however, said that every employee should get his right as per the law .
Earlier Class fourth Employees union of Forest department had moved an application in the Grievance cell blaming personal officer of the Principal Chief Conservator Amreet Singh and Private Secretary to PCCF Javid Shah for delaying the process of promotion deliberately owing to the alleged financial kick backs from some vested lobbies.
